1. COMMERCIAL POLICY

1.1. MimoArt sells products through its online store at www.mimoart.pt. Our e-commerce services are available exclusively to end users / consumers.

1.2. "Consumer" refers to any individual acting outside of their business or profession.

1.3. MimoArt reserves the right not to process orders from users who do not comply with the general terms and conditions of the online store.

1.4. These general terms and conditions of sale exclusively govern the offer, submission, and acceptance of orders placed through geral@mimoart.pt between consumers of MimoArt's online store and the seller.

1.5. The Consumer must provide the Seller with a correct and complete email address or other contact details, and agrees that the Seller may use these details to get in touch when necessary.

2. HOW TO ORDER

2.1. To place an order, you need a valid email address and a browser configured to accept cookies and pop-ups. To order:

  • Find the products you wish to purchase;
  • Add selected products to your Cart;
  • Proceed to checkout;
  • Select your payment method;
  • Review your order;
  • Complete payment and confirm your order;
  • You will receive an order confirmation by email.

Once MimoArt receives your order, you will receive the order details. The purchase agreement is finalised at that point.

We reserve the right not to accept your order, or to cancel it even after automatic confirmation has been sent.

By submitting the order form, you accept these general terms and conditions of sale, as well as any other conditions published on www.mimoart.pt.

The seller may not process orders that lack sufficient payment guarantee, are incomplete or incorrect, or where the ordered products are no longer available. In such cases, you will be notified by email explaining why the sale could not proceed.

If a product displayed on the online store is no longer available at the time of your last visit or when the seller receives the order, the seller will inform you of the unavailability within 30 days of receiving the request. If payment has already been made for an unavailable item, a full refund will be issued.

2.2. Right to refuse or cancel an order

MimoArt reserves the right to refuse any order for any reason, and to cancel any purchase (even after acceptance) in the following situations, without liability for damages or costs:

  • The product is no longer available or in stock (payments will be refunded);
  • Billing information is incorrect or cannot be verified;
  • The order is flagged by our security systems as incorrect or potentially fraudulent;
  • Payment by bank transfer has not been received within 5 days of order acceptance;
  • Delivery to the provided address is not possible.

2.3. Data verification

After receiving your order, we may carry out verification checks before processing it. These may include address verification, creditworthiness checks, and fraud screening. We run partially automated checks on all orders to filter unusual or suspicious transactions. Suspected fraud will be investigated and, if necessary, reported. By confirming your order, you agree to these conditions.

3. PAYMENT METHODS

Credit Card
You may pay by credit card and benefit from the payment terms offered by your bank. All transactions on our website are secure. MimoArt uses SSL (Secure Socket Layer) encryption technology to protect your data during transmission. MimoArt reserves the right to refuse payment for any transaction deemed unlawful. Any illegal activity will be immediately reported to the relevant authorities.

PayPal
PayPal is a secure payment method used worldwide. For more information, visit www.paypal.com. Note: MimoArt does not store any PayPal login credentials.

Multibanco
Multibanco payments can be made via ATM or online banking. Upon checkout, a Multibanco reference will be generated and sent to you by email. To pay at an ATM, select "Payment of Services/Purchases" and enter the entity, reference, and amount. Please note that the reference has a limited validity period — failure to pay within this period will result in order cancellation.

MB Way
You may pay using MB Way. During checkout, select this payment method, enter the mobile number linked to your MB Way app, and follow the confirmation steps. If the number is not registered, you will see the message: "We were unable to validate your payment." Orders paid by MB Way before 2:00 PM on a business day will typically be dispatched the same day; orders paid after this time will be dispatched the next business day.

4. ORDER SECURITY

4.1. www.mimoart.pt uses robust encryption technology. Your payment information is encrypted from the moment it is entered until the transaction is processed and is not stored on a public server. Despite our use of encryption software, the security of information transmitted over the Internet cannot be fully guaranteed. MimoArt shall not be liable for any damages resulting from the use of electronic communications, including but not limited to failures or delays in delivery, interception or manipulation by third parties, or computer viruses.

5. RETENTION OF TITLE

MimoArt retains ownership of all products until full payment has been received.

6. PRICES

6.1. All product prices displayed on the website include VAT. Shipping fees are applied per order and vary depending on the delivery country.

6.2. All prices are quoted in Euros. Please note that changing the delivery country may affect prices due to shipping costs.

6.3. Your total price, including taxes and shipping costs, is shown at the final checkout step. Please pay only the exact amount specified in your order confirmation and make individual payments per order.

6.4. MimoArt reserves the right to change product prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

6.5. While we update the website with great care, pricing errors may occasionally occur. MimoArt is not bound by any offer in the event of such an error and reserves the right to cancel the order.

7. QUALITY AND WARRANTY

MimoArt does not sell defective products or products of inferior quality to market standards. Product images on www.mimoart.pt are as accurate as possible; however, colours and appearance may vary slightly depending on your browser and monitor settings.

As our pieces are handmade, small variations in colour, texture, or the position of elements compared to the images may occur. These differences are part of each piece's unique character and reflect the handmade process.

8. SHIPPING AND DELIVERY

8.1. We deliver Monday to Friday, 9am–6pm. We do not ship on certain public holidays. Delivery is only available to residential or business addresses in the countries listed at checkout.

Someone must be present at the delivery address to receive the order. This service does not include scheduled delivery slots; the courier will deliver without prior contact. Delivery times may not be guaranteed during promotional periods, sales, Christmas, epidemic situations, or in cases of stock shortage.

Delivery is considered complete upon signature of the delivery receipt at the agreed address.

8.2. Delivery Times

As our pieces are handmade and produced to order, production time is approximately 1 week, depending on complexity and order queue.

After production, estimated delivery times are as follows:

  • Portugal: 2–5 business days
  • Europe: 10–15 business days
  • Rest of the world: 15–25 business days

Orders confirmed and paid by Credit Card, MB Way, or PayPal before 12:00 PM on a business day will enter the production queue the following business day (weekends and public holidays are not considered business days). Orders paid by Multibanco reference may take longer, as production only begins once payment is received (typically 5–7 days).

MimoArt shall not be liable for any failure or delay in fulfilling obligations due to force majeure events beyond its reasonable control.

8.3. Partial Deliveries

We will endeavour to deliver all items in a single shipment. However, we reserve the right to split deliveries where necessary (e.g. if part of the order is delayed or unavailable). In such cases, you will be notified by email at the address provided at the time of purchase.

8.4. Inspection upon delivery

Upon delivery, please inspect the packaging for any damage. If products appear damaged, do not accept the delivery — it will be returned. MimoArt will issue a full refund for the order and shipping costs once the warehouse receives and processes the return.

Any claim for non-receipt of an order must be made within 30 days of the order date. After this period, MimoArt cannot be held responsible for the loss.

9. SHIPPING FEES

9.1. Shipping fees are applied per order. The exact cost depends on the delivery country.

9.2. Free shipping is available when the order value exceeds the minimum threshold defined for your country or applicable campaign.

10. RETURNS

10.1. Order cancellation before dispatch
You may cancel your order as long as it has not yet been dispatched. To cancel, please contact our Customer Support at geral@mimoart.pt.

If the cancellation is successful, you will be notified by email and no charges will apply. If cancellation is no longer possible, the products will be dispatched and you may refuse delivery. Once returned and processed, a refund will be issued.

10.2. Return of defective products
You have the right to return products that are defective or do not conform to your order. Returns must be made within 30 days of receiving the order. If your claim is valid, the product price and shipping costs will be refunded.

10.3. Return due to withdrawal
If for any reason you are not satisfied with your order, you may return the products within 30 calendar days of receipt, provided that:

  • The products have not been used;
  • The product retains its original characteristics and the packaging is undamaged (carefully opened packaging will not be considered damaged);
  • The products have not been altered.

10.4. Return of gifts
At this time, it is not possible for a gift recipient to return a product directly. The original purchaser must initiate the return in accordance with these Return Conditions.

10.5. Product exchanges
To exchange an item, please follow the steps outlined in our Shipping and Returns policy.

10.6. Return information
Return shipping costs are the responsibility of the customer, except in cases of defective or non-conforming products. Refunds will be processed based on the original payment method. If payment was made by Multibanco reference, please provide your bank details to our Customer Support when initiating the return. Refunds will be processed once the product(s) have been returned and inspected.

12. PROMOTIONAL CODES

12.1. When used in accordance with the applicable rules, a promotional code entitles the user to a discount on a specific product or set of products during the period associated with the code or campaign.

12.2. Promotional codes may only be used for online purchases made on the website.

12.3. Each promotional code may only be used once per product and per order. Promotional codes cannot be combined with any other promotions or special offers.

12.4. Promotional codes cannot be exchanged for cash.

12.5. Offers on the website are valid only while displayed, unless otherwise stated. MimoArt is not bound by any offer in the event of typographical, pricing, or other errors on the website, and reserves the right to cancel any sale made under such errors.

12.6. MimoArt reserves the right to immediately invalidate a promotional code if there are reasonable grounds to suspect it is being used in violation of these terms, through misappropriation, or in any other manner that justifies such action.

13. LIABILITY

13.1. MimoArt shall only be liable for damages suffered by the customer where such damages result from a breach of MimoArt's contractual obligations, or where liability arises under applicable law.

13.2. Where the customer has suffered damages related to the website's activity, MimoArt's liability shall be limited to direct damages to MimoArt products or materials.

13.3. MimoArt shall not be liable for damages suffered by third parties resulting from the use of any of our products, nor for damages suffered by the customer as a result of improper use of our products.

14. APPLICABLE LAW

These general terms and conditions, and any disputes arising in connection with them — including their validity, use of the website, or any purchase made thereon — shall be governed by Portuguese law.

15. WEBSITE INFORMATION

MimoArt shall not be liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or inaccuracies in the information provided, unless such damage results from wilful misconduct or negligence on the part of MimoArt.

16. TRADEMARKS AND COPYRIGHT

All brand names, product names, and titles used on the website are trademarks or registered names of MimoArt, or trademarks and registered names of their respective owners. Users are not authorised to use or reproduce any such trademarks or registered names, as doing so constitutes an infringement of the rights of their owners.

All content relating to the design, text, documents, films, music and/or other services on the website, its selection and organisation, all compiled software, and all other website materials are the property of MimoArt and its suppliers. Users are not authorised to make any other use of the website or its content, including reproduction for purposes other than those stated above, modification, distribution, or republication.

17. ALTERNATIVE DISPUTE RESOLUTION

Alternative dispute resolution (ADR) gives consumers access to official bodies that can help resolve or guide them through conflicts. The Online Dispute Resolution (ODR) platform is an official website managed by the European Commission to help consumers and traders resolve disputes out of court: https://ec.europa.eu/consumers/odr/

Customers defined as consumers under Law 144/2015 who have entered into purchase and/or service contracts have the right to use ADR entities to resolve disputes arising from such contracts, without prejudice to their right to seek recourse through the courts.
